Harrisville, NY School Nurse Sued For “Prying” Open Student’s Rectum And Vagina

December 19, 2016 (Fault Lines) — If this young lady’s complaint for damages reflects what happened to her at the hand of one nurse and a group of NY school employees, the nurse’s actions were a flagrant betrayal of nurses’ Florence Nightinghale Pledge, to “abstain from whatever is deleterious and mischievous.”

It would also be rape, after school nurse Kelly Avallone purportedly laughed and said, “This is a first for Harrisville.” Courthouse News reports on Jane Doe’s complaint:

Upon learning that other students had accused her of possessing drugs, Doe insisted that the allegations were false. The complaint says Doe offered to let Luther search her backpack in front of her, but that the school officials had a more humiliating search in mind. Doe had to leave her backpack behind, according to the complaint, while Luther and Bird took her to the nurse’s office with a change of clothes.

“Jane was told that she would undergo a ‘strip search,” the complaint states. With Avallone and Bird looking on, Doe says she followed orders to disrobe completely. Despite the spare set of clothes on hand, the women allegedly forced Doe “to stand exposed for several minutes” while they inspected her shirt, bra, boots, pants and underwear. “No drugs, contraband, or any other prohibited substances were located in any of Jane’s clothes,” the complaint states.

Then nurse Avallone allegedly offered to perform a rectal exam.

Two members of the New York State Police were standing outside the main office while this nefarious conduct was unfolding. Those who’ve been paying attention already know that “To Protect and Serve” is malarkey, but this shameful episode goes above and beyond the (detached?) indifference that’s come to be expected. A clan of anal-retentive (no pun) school wannabe-screws proceeded to bully, humiliate, strip, and penetrate a girl against her will, all whilst two of NY’s finest literally stood guard. All based on tips from unindicted cooperating witnesses ratty classmates.

“No,” Jane said immediately, according to the complaint, which continues to say that “Jane clearly indicated to defendants Bird and Avallone that she was not willing to undergo a rectal exam.”Doe says Bird warned her that there would be a “serious problem” if she “put anything up there.”

“Scared and disturbed by the mention of a rectal exam, Jane pleaded to defendants Avallone and Bird to let her urinate in a toilet to prove she was not concealing anything in her rectum,” the complaint states. Doe says they took her up on her offer, with Avallone watching as she urinated.

Though Doe urinated normally, the nurse ordered Doe, flashlight in hand, to turn around “Jane protested and said ‘no!’,” the complaint states. “Bend over,” the nurse said next, according to the complaint, as she then “pried Jane’s buttocks apart with her hand, exposing Jane’s rectal cavity.”

Ordered after to “turn around,” Doe says she complied with Avallone’s orders “to expose her vagina for examination.”

If this post was on paper, I would ask that you put a pencil line under the words “pleaded,” “bend over,” and “pried.” The girl told her tormentors – not that she had an affirmative duty to do so — that she objected to this assault, but these animals remained strident and directed her to bend over so they could pry her genitals open and penetrate her against her will.

Part of the irony here is that the nurse instigated this insanity, as she was the only conspirator who had dedicated herself to the “service to human welfare.” That nurse’s newfound endeavor might involve steering clear of an indictment, as the story gets much, much worse:

“Using her hand, Defendant Avallone pried apart the opening to Jane’s vagina and shined her flashlight inside,” the complaint states. As with the student’s rectal cavity, the complaint says “there was absolutely nothing concealed in Jane’s vagina.” Doe says she requested to call her father while she was dressing but that Bird said no and offered no explanation.

When the girl asked the principal confederate for his justification for this assault, he replied that she should stop having her name “associated with people with drugs.” Well, let’s take this literal, lazy, and moronic busybody at his word. What he suggests for the girl is impossible to achieve, because she does not know for certain which of her classmates are “associated” with narcotics. This rings similar to the absurd “drug free zone” signs around schools, as if no one with a phone and ten minutes to spare couldn’t render that sign meaningless.

When it comes to the nurse and her cohorts, one wonders whether they’ve heard about other school employees using compulsory strip searches to look for drugs, or whether this nurse read up on doctors looking inside body cavities at the behest of law enforcement despite the patient’s defendant’s objections. Were they privy to the U.S. Supreme Court’s decision that gave the kosher stamp to prison officials degrading county jail inmates via strip searches?

It’s debatable (one of Miami cops’ favorite retorts during depositions). But if their feeble, yet terminally authoritarian minds got around to reading anything of the sort, these people would see it as a green light to use a flashlight to look into a girl’s vagina and rectum for some non-existent dope. There was no dope on her person, but she was still forced to disrobe and bend over in front of strangers, for naught.

This happened to a student in an American institution, under the auspices of two NY cops. An underage girl was taken inside a principal’s room, where she was told to strip while a school nurse laughed and perptrated a sexual assault. The school has yet to respond the lawsuit, although it will prove difficult, if not impossible, to justify the forcible rape of student.

    Lewis County’s DA has the reputation of prosecuting innocent parties to protect the locals who commit similar crimes.

    I thought that school would be the last bastion of safety for children. This DEPRAVITY is equal to inviting the rapist in! The bell can not be unrung for that girl. Violation is violation! I hope this case is won by her and sets a precedent that it can never happen again! I hope the Nurse and co=conspirators get serious jail time!

    One needs to ask why the school “nurse” is not being prosecuted for sexual assault.

    Even in the “Great State of Texas” where they love their cops, two state troopers (supposedly the cream of the crop in Texas “policing”) were prosecuted for conducting roadside cavity searches.

    If I recall correctly, one plead out to a misdemeanor and fired, the other was fired and charges were dismissed, a slap on the hand, but at least three were consequences. Due to the convictions, they cannot be cops anywhere int Texas.

    Whatever agency certifies and licenses nurses in New York Sate needs to have a look at this and revoke Avallone’s nursing credentials.

    Let’s hope that if the local DA (usually worthless when prosecuting governmental officials – unless the prosecution is politically motivated) doesn’t at least take this to a grand jury, the Feds will take a look at it.

    Let’s also hope that Doe wins BIG BIG BIG against the schools and personally against the officials who perpetrated this atrocity.
